Abstract |

|
This
case concerns enforcement proceedings brought by the European
Commission against Greece in respect of a failure to properly
implement the 1992 Habitats Directive. Specifically, the case
concerned certain failures to implement measures to protection
the Mediterranean sea turtle habitats on beaches in Greece.
Although the proceedings were finally determined some
considerable time after the failure by Greece to implement
measures actually occurred, the case does illustrate the unique
role of the ECJ in deciding cases against EC Member States.
