Abstract |

|
This case forms
part of the extensive "tuna-dolphin" litigation in the United
States. The plaintiffs, an environmental coalition,
sought a preliminary injunction to prevent
the US Government from lifting the embargo against tuna
from Mexico's vessels in the Eastern Pacific Ocean. Plaintiffs
alleged irreparable injury as the lifting of
the ban could lead to three stocks of dolphins
becoming critically endangered or
extinct. The court found plaintiffs failed to produce evidence
showing irreparable injury.
