Abstract

 
Criminal proceedings brought by the Canadian Government alleging the unlawful setting of gill nets, which had led to the catch of prohibited species. Although it was not disputed that the nets, when found, did not comply with applicable regulations, the prosecution was unable to prove that they had been set improperly by the accused, whom the Court considered had met "due diligence" requirements in the legislation.
